Terms of service

1. Who you are agreeing with

unfckd.dev is operated by LuvvSum, an individual based in the Netherlands, referred to below as "we" or "us". Contact details are on the legal notice page.

2. What these terms cover

These terms apply when you visit or use unfckd.dev. By using the site you accept them. If you do not accept them, stop using the site.

They do not apply to the following.

• unfckd-lite. Covered by GPL-3.0. See section 3.
• The Unfckd dashboard. Not released. It will have its own terms before it opens, and those will govern it.
• GitHub and Discord. Separate services with their own terms.

3. unfckd-lite is licensed under GPL-3.0, not under these terms

unfckd-lite is free software. We license it to you under version 3 of the GNU General Public Licence, and the full text ships with the source at https://github.com/unfckd/unfckd-lite. That licence, and only that licence, governs your rights to run, study, change, and redistribute the software.

Nothing in these terms restricts, qualifies, or adds a condition to the rights GPL-3.0 grants you. We could not do that even if we wanted to, because imposing further restrictions would itself breach the licence. If any sentence on this page ever reads as limiting your GPL rights over the software, treat that sentence as having no effect.

4. Using the website

You may read the site, link to it, and quote reasonable extracts with attribution. You agree not to do the following.

• Attack the site or the infrastructure behind it, including denial of service attempts
• Try to gain access to systems or data you have no right to
• Scrape the site so aggressively that it degrades service for other people
• Present yourself as us, or imply we endorse you when we do not
• Use the site to break the law

The acceptable use policy covers this in more detail and forms part of these terms.

5. What we own, and what you may reuse

The Unfckd name, the logo, the wordmark, and the design of this website belong to us. Trade mark rights are not granted by the GPL, so the licence over the software does not give you permission to use our name or logo to brand your own project or to suggest we are behind it.

You may use the name to refer to the project accurately, for example to say that your server was scanned with unfckd-lite. That is ordinary descriptive use and we have no objection to it.

6. No warranty for the website

We provide the website as it is. We do not promise that it will always be available, that it will be free of errors, or that any part of it will suit a particular purpose. We may change the content, move pages, or take the site down.

The software carries its own disclaimer in sections 15 and 16 of GPL-3.0, and that is what governs it. The disclaimer page explains in plain words what that means in practice.

7. Scan results are advisory

unfckd-lite reports problems it can detect by reading manifest files. It cannot find every problem, and a clean report does not prove your server is healthy. You stay responsible for your own server, your own backups, and for checking any change before you apply it to a live server.

8. Limitation of liability

To the extent Dutch law allows, we are not liable for indirect or consequential loss arising from your use of the website or the software. That includes lost players, lost revenue, lost data, and server downtime.

Some liability cannot be excluded and we do not try to exclude it. Specifically, nothing in these terms limits our liability for the following.

• Death or personal injury caused by our negligence
• Intent or deliberate recklessness on our part, which Dutch law calls opzet or bewuste roekeloosheid
• Fraud or fraudulent misrepresentation
• Anything else the law does not permit us to exclude

9. If you are a consumer

If you use this site as a consumer rather than for a business, you keep every right that mandatory Dutch and EU consumer law gives you. Nothing in these terms takes those rights away or reduces them, and where a clause here conflicts with such a right, the right applies instead.

10. Links to other sites

We link to GitHub, Discord, and other places. We do not control them and we are not responsible for what they contain or do. A link is not an endorsement.

11. Changes to these terms

We may update these terms. The date at the top shows the last substantive change. Continuing to use the site after a change means you accept the new version. If a change is significant we will make it obvious rather than slipping it in.

12. If part of this is unenforceable

If a court finds any clause here invalid, the rest stays in force, and the invalid clause is read down to the narrowest form that is enforceable rather than struck out entirely.

13. Governing law and courts

Dutch law governs these terms. Disputes go to the competent court in the Netherlands.

If you are a consumer living in another EU country, this does not remove your right to rely on the mandatory consumer law of the country you live in, or to bring proceedings there where EU rules allow it.
